(2) Subsection (1) does not apply in respect of a ship (a) that is fitted with an overflow system that prevents oil from discharging onto the open deck; or (b) that usually fills its bunkers from a truck and is equipped with a bunkering hose that has an inside diameter of 51 mm or less and employs an automatic shut-off nozzle.
