5 Da Tribunal de paix de Luxembourg fandt, at dette anbringende måtte anses for en modfordring om bortfald af pligten til at betale underholdsbidrag, og idet Tilly Reichling er bosiddende i Frankrig, fandt retten, at det var nødvendigt at forelægge følgende spørgsmål for Domstolen til præjudiciel afgørelse:

5 Το Tribunal de paix de Luxembourg, ερμηνεύοντας αυτόν τον αμυντικό ισχυρισμό ως ανταγωγικό αίτημα περί καταργήσεως της διατροφής και λαμβανομένου υπόψη ότι η T. Reichling είναι κάτοικος Γαλλίας, έκρινε αναγκαίο να υποβάλει στο Δικαστήριο τα ακόλουθα προδικαστικά ερωτήματα:

5 Treating the defence as a cross-petition for the termination of maintenance payments, and having regard to the fact that Ms Reichling is domiciled in France, the Tribunal de paix de Luxembourg held it necessary to refer the following questions to the Court of Justice for a preliminary ruling:
