১৮৫৯ সালের বঙ্গীয় খাজনা আইনের ১৭ ও ১৮ ধারায় সন্নিবেশিত প্রজাস্বত্ব আইনে এই অনুসিদ্ধান্তমূলক নীতি স্বীকার করে নেওয়া হয় যে, পয়স্তিক্রমে কোন প্রজার জমির আয়তন বেড়ে গেলে তাকে বাড়তি খাজনা দিতে হবে, আর কমে গেলে বা শিকস্তির ক্ষেত্রে যে পরিমাণ জমি তার ভূমিক্ষয়জনিত কারণে কমে যাবে, সে অনুপাতে তত পরিমাণ কম খাজনা দেওয়ার অধিকারী হবে।

The tenancy law, as contained in sections 17 and 18 of the Bengal Rent Act 1859, recognised the corollary principle that the tenant was liable to enhancement of rent in case of increase of area of his land by alluvion and he is entitled to a reduction of rent in the event of decrease of the area of land by diluvion.
