A new procedure is established for the Constitutional Court to resolve disputes of an institutional nature in which the Basque Government shall take legal action against the Government of the State when the latter declares itself not to have the authority to exercise the powers conferred upon it by the Constitution or Laws with regard to the Community of the Basque Country.

Se establece un nuevo procedimiento de conflicto de competencias negativo ante el Tribunal Constitucional, que tendrá como actor al Gobierno Vasco y como órgano requerido al Gobierno del Estado, por declararse éste incompetente para ejercitar las atribuciones que le confieren la Constitución o las Leyes en relación a la Comunidad de Euskadi.

Eskumen-gatazka negatiboaren prozedura berri bat ezartzen da Konstituzio Auzitegirako, eta bertan Eusko Jaurlaritza izango da auzi-jartzaile eta Estatuko Gobernua organo errekeritu, Konstituzioak zein legeek Euskadiko Erkidegoarekiko ematen dizkioten eskurantzak erabiltzeko eskumenik gabeko aitortzen duenean bere burua azken horrek.

Une nouvelle procédure de conflit de compétences négatif sera établie auprès du Tribunal Constitutionnel, dont lacteur sera le Gouvernement Basque et lorgane mis en demeure, le Gouvernement de lÉtat, celui-ci se déclarant incompétent pour exercer les attributions qui lui sont conférées par la Constitution ou les Lois en rapport avec la Communauté du Pays Basque.
