وقرّرت المحكمة الابتدائية ومحكمة الاستئناف على السواء أن المشتري لم يُخطر البائع بعدم مطابقة البلاط في غضون المدة المعقولة لاكتشاف العيب، حسبما تقضي به الفقرة (1) من المادة 39 من اتفاقية البيع الدولي، لأنه علم من زبونه هو في تموز/يوليه 1991 أن البلاط غير مطابق للعقد، لكنه لم يبلغ البائع بعدم المطابقة حتى تشرين الثاني/نوفمبر من تلك السنة.

Both the Court of First Instance and the Court of Appeal determined that since the buyer was informed by its customer that they did not conform to the contract in July 1991, but did not inform the seller of their lack of conformity until November of that year, it had failed to give notice to the seller of the lack of conformity of the tiles within a reasonable time of discovery, as required by article 39 (1) CISG.

Tanto el Tribunal de Primera Instancia como el Tribunal de Apelación determinaron que, habida cuenta de que en julio de 1991 el comprador fue informado por su cliente de que las mercancías no se ajustaban a lo pactado en el contrato, si bien no informó al vendedor de la falta de conformidad hasta noviembre del mismo año, es evidente que no notificó al vendedor la falta de conformidad de los azulejos en un plazo razonable para que lo descubriera, como prescribe el artículo 39 1) de la CIM.

И суд первой инстанции, и апелляционный суд определили, что, поскольку покупатель был уведомлен его клиентом о том, что плитка не соответствует договору, в июле 1991 года, но не уведомил продавца об отсутствии соответствия плитки до ноября этого года, он не направил уведомление продавцу об отсутствии соответствия керамической плитки в течение разумного срока после установления этого факта, как это требуется статьей 39 (1) КМКПТ.
