ويعود أصل تعبير "تحيل الطرفين إلى التحكيم" إلى بروتوكول جنيف الذي ينصُّ، في الجزء ذي الصلة، على أنَّ "على محاكم الأطراف المتعاقدة أن تحيل الطرفين إلى قرار المحكَّمين بناءً على طلب أيٍّ منهما."(

The expression “refer the parties to arbitration” has its origin in the Geneva Protocol, which provides, in relevant part, that the “tribunals of the Contracting Parties [...] shall refer the parties on the application of either of them to the decision of the arbitrators.”
