ويمكن القول في هذا الصدد بأن ذلك من أساليب "السياسة القضائية" للمحكمة ونتيجة للسلطة التقديرية التي يملكها القاضي لاختيار الأسلوب الأمثل لتسبيب أحكامه، وفقاً لمفهومه لوظيفته.
