وتشير اللجنة الفرعية إلى أنه بعد اعتماد المرسوم رقم 168/11، باتت مديرية التفتيش والمراقبة، التي تقدم التقارير إلى الأمانة الفرعية المعنية بالسياسة الجنائية والتحقيقات القضائية التابعة لوزارة العدل والأمن في إقليم بوينس آيرس، مسؤولة عن الإجراءات المتعلقة بأعمال التعذيب وسوء المعاملة وغيرها في المؤسسات الإصلاحية.

The Subcommittee notes that following the adoption of Decree No. 168/11, the Inspection and Control Directorate, which reports to the Under-Secretariat for Crime Policy and Judicial Investigations of the Ministry of Justice and Security of Buenos Aires province, is responsible for procedure relating, inter alia, to acts of torture and ill-treatment in penal establishments.

El SPT toma nota de que, tras la adopción del Decreto n° 168/11, corresponde a la Dirección de Inspección y Control, dependiente de la Subsecretaría de Política Criminal e Investigaciones Judiciales del Ministerio de Justicia y Seguridad de la Provincia de Buenos Aires, la sustanciación de los sumarios administrativos relacionados, entre otros, con hechos de tortura y malos tratos en los establecimientos penitenciarios.

Le SPT note que depuis l’adoption du décret no 168/11, il incombe à la Direction de l’inspection et du contrôle, qui relève du Sous-Secrétariat de la politique criminelle et des enquêtes judiciaires du Ministère de la justice et de la sécurité de la province de Buenos Aires, d’instruire les dossiers administratifs portant notamment sur les faits de torture et de mauvais traitements dans les établissements pénitentiaires.

ППП принимает к сведению тот факт, что на основании Указа No 168/11 за ведение административных расследований, в том числе в связи с актами пыток и неправомерного обращения, отныне отвечает Инспекционно-контрольное управление при Департаменте уголовной политики и судебных расследований Министерства юстиции и безопасности провинции Буэнос-Айрес.
