وهذا الشرط يجسد الموقف المشترك في عدد من البلدان المختلفة؛ إذ إن مقدم الطلب سيقع على عاتقه التزام برفع دعوى موضوعية، في غضون فترة معقولة من الزمن، إما في بلد المحكمة وإما في الخارج، كما ينبغي أن يكون ثمة إمكانية معقولة لكي يكون أي حكم يصدر في الخارج معترفا به في مكان المحكمة التي منحت الانتصاف المؤقت.

This condition reflects the common position in a number of different countries; the applicant would have an obligation to file a substantive action, within a reasonable time, either in the forum or abroad and there should be a reasonable possibility that any judgement rendered abroad would be recognized in the forum which granted the interim relief.
