وينص أيضاً على أن "اعتماد تدابير خاصة مؤقتة من أجل الوصول إلى تحقيق مساواة فعلية بين الرجل والمرأة وللمجموعات المحرومة ليس انتهاكاً للحق في عدم التمييز بالنسبة للتعليم، ما دامت هذه التدابير لا تؤدي إلى الإبقاء على معايير غير متكافئة أو منفصلة للمجموعات المختلفة، بشرط ألا تستمر بعد بلوغ الأهداف التي اتخذت من أجلها".

It further stipulates that “the adoption of temporary special measures intended to bring about de facto equality for men and women and for disadvantaged groups is not a violation of the right to non-discrimination with regard to education, so long as such measures do not lead to the maintenance of unequal or separate standards for different groups, and provided they are not continued after the objectives for which they were taken have been achieved”.

Estipula asimismo que "la adopción de medidas especiales provisionales destinadas a lograr la igualdad de hecho entre hombres y mujeres y de los grupos desfavorecidos no es una violación del derecho de no discriminación en lo que respecta a la educación, siempre y cuando esas medidas no den lugar al mantenimiento de normas no equitativas o distintas para los diferentes grupos, y a condición de que no se mantengan una vez alcanzados los objetivos a cuyo logro estaban destinadas".
