بيد أن هناك عددا من المجالات التي لا تتساوق فيها أحكام الدستور الوطني الانتقالي مع معاهدات حقوق الإنسان والمعايير الدولية، ويشكل ذلك تضاربا في الدستور، لا سيما في مجال التساوق بين القانون العرفي المضمن في الدستور، وواجبات والتزامات حكومة السودان بموجب معاهدات حقوق الإنسان الدولية ذات الصلة.

There are a number of areas, however, where the provisions of the Interim National Constitution are not in coherence with international human rights treaties and norms and this represents a dichotomy in the Constitution, particularly in the area of coherence between customary law enshrined in the Constitution and the duties and obligations of the Government of the Sudan under the relevant international human rights treaties.

Il y a toutefois certains points où la Constitution provisoire n’est pas alignée sur les traités internationaux portant sur les droits de l’homme, ce qui y représente une dichotomie, surtout en ce qui concerne la cohérence entre le droit coutumier inscrit dans la Constitution et les devoirs et obligations du Gouvernement soudanais procédant des traités internationaux pertinents concernant les droits de l’homme.
