Tyto náklady, tzn. odměna exekutora, jeho hotové výdaje a další, získávají při rozvrhu rozdělované podstaty povahu pohledávek prvé skupiny a uspokojují se tedy přednostně, to znamená i před samotnou pohledávkou oprávněného, pro jejíž úhradu je exekuce vedena.
