وعليه، كان يعتبر مناسباً إدراج فقرة في مشروع القرار عن المحيطات وقانون البحار تشير إلى الفقرة 3 من المادة 77 من الاتفاقية، وتنص على أن حقوق الدول الساحلية في الجرف القاري لا تعتمد على موقع مؤثر أو افتراضي، أو على أي إعلان محدد.

Accordingly, it was considered appropriate to include a paragraph in the draft resolution on oceans and the law of the sea referring to article 77, paragraph 3, of the Convention and spelling out that the rights of the coastal State over the continental shelf do not depend on occupation, effective or notional, or on any express proclamation.

On a donc jugé opportun d’inclure dans le projet de résolution sur les océans et le droit de la mer un paragraphe qui renvoie au paragraphe 3 de l’article 77 de la Convention stipulant que les droits de l’État côtier sur le plateau continental sont indépendants de l’occupation effective ou fictive, aussi bien que de toute proclamation expresse.

Поэтому было сочтено целесообразным включить в проект резолюции относительно Мирового океана и морского права пункт, касающийся пункта 3 статьи 77 Конвенции и четко излагающий, что права прибрежного государства на континентальный шельф не зависят от эффективной или фиктивной оккупации им шельфа или от прямого об этом заявления.
