Som misbrug af faellesskabslovgivningen betragtes handlinger, der er foretaget med det formaal at opnaa en uberettiget fordel, saaledes at der ved hjaelp af fiktive eller kunstige transaktioner skabes en situation, det formelt er i overensstemmelse med lovgivningen, men som er uden noget reelt oekonomisk formaal og i modstrid med faellesskabslovgivningens sigte.

Αποτελούν κατάχρηση της κοινοτικής νομοθεσίας οι πράξεις που έχουν αναληφθεί με σκοπό να αποκτηθεί αχρεωστήτως όφελος δημιουργώντας μέσω εικονικών τεχνητών ενεργειών κατάσταση τυπικά σύμφωνη με τις νόμιμες προϋποθέσεις, ενώ στερούνται πραγματικού οικονομικού λόγου και είναι αντίθετες προς τους στόχους της εν λόγω κοινοτικής νομοθεσίας.

'Abuse of Community law` means an act is done for the purpose of obtaining an unwarranted advantage by means of fictitious or artificial operations designed to create a situation that is formally in accordance with the law but is devoid of any real economic purpose and is contrary to the purpose sought by the material instrument of Community law.

Se considerarán como abuso de la normativa comunitaria, los actos realizados con el fin de obtener una ventaja indebida, mediante la creación, a través de operaciones ficticias o artificiales, de una situación formalmente conforme a las condiciones legales, cuando estas operaciones carezcan de motivación económica pertinente y sean contrarias a las finalidades de la legislación comunitaria de que se trate.
