2 Tyto otázky byly vzneseny v rámci sporů mezi jednak manžely Baumbastovými, jakož i Marií Fernandou Sarmiento a Idanellou Baumbast (dále jen společně „rodina Baumbastových“), a jednak R proti Secretary of State for the Home Department (dále jen „Secretary of State“) ve věci zamítavého rozhodnutí Secretary of State vydat povolení k pobytu na území Spojeného království.
