قدمت الدولة الطرف ملاحظات إضافية، تمسكت فيها بأن البلاغ ينبغي أن يعتبر غير مقبول، بما أن صاحب البلاغ، وبحكم درايته بالنظام الهولندي، كان يدرك استحالة الطعن بالنقض في قرار صادر عن محكمة استئناف يقضي برفض الاستئناف، وكان ينبغي من ثم أن يثير موضوع هذا البلاغ في مرحلة الإجراءات المحلية.

The State party submitted additional observations, maintaining that the communication should be declared inadmissible, as the author, being familiar with the Dutch system, was aware that it was not possible to institute an appeal in cassation against an appellate court’s decision to dismiss an appeal and therefore should have raised the substance of his communication at that stage of the domestic proceedings.

El Estado parte presentó observaciones adicionales en las que reiteró que la comunicación debería declararse inadmisible, ya que el autor, que conocía el sistema neerlandés, sabía bien que no era posible presentar un recurso de casación contra una decisión de no admisión a trámite adoptada por un tribunal de apelación y, por lo tanto, debió haber planteado los elementos de fondo de su comunicación en esa etapa de los procedimientos internos.

L’État partie a fait parvenir des commentaires supplémentaires, réaffirmant que la communication devait être déclarée irrecevable vu que l’auteur, qui connaissait bien le système néerlandais, savait qu’il était impossible de se pourvoir en cassation contre le refus de la cour d’appel de l’autorisation de faire appel et qu’il aurait donc dû exposer le fond de sa communication à ce stade des procédures nationales.

Государство-участник представило дополнительные замечания, в которых оно указывает, что сообщение следует признать неприемлемым, поскольку автор, будучи знаком с голландской системой, понимал невозможность обжалования в кассационном порядке решения апелляционного суда отказать в праве на апелляцию и поэтому должен был бы поставить вопрос по существу своего заявления на стадии разбирательства в национальных судах.
