وترجع هذه الضرورة إلى أنه في الحالات التي لا يمكن فيها اللجوء إلى تحكيم المركز الدولي لتسوية منازعات الاستثمار، يشترط الحصول على براءة تنفيذ من المحاكم الوطنية، وهذا ينطوي على إجراء باهظ التكلفة ويستغرق وقتاً طويلاً.

This was because, where it was not possible to have access to arbitration by the International Centre for Settlement of Investment Disputes (ICSID), an exequatur was required from the national courts, and this involved a costly and time-consuming procedure.
