৭৯। অধিকার লঙ্ঘনকারী অনুলিপির দখলকার বা লেনদেনকারী ব্যক্তির বিরুদ্ধে মালিকের অধিকার:- কপিরাইট বিদ্যমান আছে এমন কোন কর্মের অধিকার লঙ্ঘনকারী সকল অনুলিপি এবং ঐরূপ অধিকার লঙ্ঘনকারী অনুলিপি তৈরীর জন্য ব্যবহৃত বা ব্যবহারের জন্য উদ্দীষ্ট প্লেট এবং কম্পিউটার প্রোগ্রামের ক্ষেত্রে সংশ্লিষ্ট সোর্স কোড কমপাইলেশন, ডাটা, ডিজাইন ডকুমেন্টেশন, টেবিল এবং আনুষঙ্গিক চার্টসমূহ কপিরাইটের মালিকের সম্পত্তি বলে গণ্য হবে, যিনি তাদের দখল পুনরুদ্ধারের বা তাদের রূপান্তর সম্পর্কে আইনগত কার্যক্রম গ্রহণ করতে পারবেন: তবে শর্ত থাকে যে, কপিরাইটের মালিক কোন অধিকার লঙ্ঘনকারী অনুলিপির রূপান্তর সম্পর্কে কোন প্রতিকার পাবেন না, যদি বিবাদী প্রমাণ করেন যে-

Right of owner against persons possessing or dealing with infringing copies.- All infringing copies of any work in which copyright subsists, and all plates used or intended to be used for the production of such infringing copies, and in case of a computer programme related source code, compilation, data, design documentation and relevant charts, shall be deemed to be the property of the owner of the copyright, who accordingly may take proceedings for the recovery of possession thereof or in respect of the conversion thereof: Provided that the owner of the copyright shall not be entitled to any remedy in respect of the conversion of any infringing copies, if the opponent proves-
