وكما كان الحال بالنسبة للصلاحية السابقة للمحكمة العليا، فإنه بموجب المادة 105 الحالية من الدستور، تستطيع الآن اللجنة الوطنية لحقوق الإنسان أن تفتح تحقيقا في وقائع تشكِّل انتهاكات خطيرة لحقوق الإنسان ”متى ارتأت أن من المناسب القيام بذلك أو بناء على طلب من السلطات التنفيذية الاتحادية، سواء من مجلسي البرلمان الاتحادي، أو من حاكم الولاية، أو من رئيس الحكومة في منطقة العاصمة الاتحادية، أو من الكيانات التشريعية أو الاتحادية“.

As was the case with the previous power of the Supreme Court, under the present article 105 of the Constitution the CNDH can now open an investigation into facts that constitute serious violations of human rights "when it deems this appropriate or at the request of the federal executive, either of the chambers of the federal Congress, the governor of a state, the head of government of the Federal District, or the legislatures of the federative entities."

Al igual que en el caso de la anterior facultad de la SCJN, ahora, conforme al artículo 105 constitucional, la CNDH puede iniciar una investigación sobre hechos que constituyan violaciones graves de derechos humanos “cuando así lo juzgue conveniente o lo pidiere el Ejecutivo Federal, alguna de las Cámaras del Congreso de la Unión, el gobernador de un Estado, el Jefe de Gobierno del Distrito Federal o las legislaturas de las entidades federativas.

Comme pouvait le faire la Cour suprême de justice de la Nation, aujourd’hui, la CNDH peut, en vertu de l’article 105 de la Constitution, ouvrir une enquête sur des faits qui constituent des violations graves des droits de l’homme, sur l’avis ou à la demande de l’Exécutif fédéral, de l’une des Chambres du Congrès de l’Union, du gouverneur d’un État, du Chef de gouvernement du District fédéral ou des parlements des entités fédérées.

Так же как ранее ФВС, НКПЧ может в настоящее время на основании статьи 105 Конституции инициировать проведение расследования по фактам, представляющим собой грубое нарушение прав человека, "если она сочтет это необходимым или если это будет предложено ей федеральными органами исполнительной власти, любой из палат Конгресса, губернатором штата, руководителем правительства Федерального округа или законодательным собранием субъекта Федерации".
