وتتعلق المواد المطعون فيها بالحد الأدنى لسن الزواج، والوصاية القانونية التي تعطى الأولوية فيها للجد من ناحية الأب، على أن تأتي الجدة من ناحية الأم في نهاية المطاف، وحق المرأة المتهمة (في حالة الانفصال أو الطلاق) في الحصول على نفقة إذا التزمت ”بحسن السير والسلوك“، والفترة التي يجب على المرأة الالتزام بها قبل الزواج مرة أخرى، وعدم إلزام الرجل بذلك، وغير ذلك من المواد التي تنطوي على أحكام غير موضوعية وتمييزية.

Among other articles containing subjective and discriminatory provisions, the articles in question refer to the minimum age of marriage; the exercise of legal guardianship, in which paternal grandfathers are given priority and maternal grandmothers come last; the right of a wife who was not at fault, in a case of separation or divorce, to receive alimony as long as she behaves “decently”; and the period of time that a woman must wait before remarrying, whereas men are not subject to any such provision.

Los artículos impugnados se refieren a la edad mínima para contraer matrimonio, el ejercicio de la tutela legítima que da prioridad a los abuelos paternos dejando en último lugar a las abuelas maternas; el derecho que tiene la mujer inculpable (en caso de separación o divorcio) de percibir pensión alimenticia mientras observe “buena conducta”; el plazo que debe esperar la mujer para contraer nuevas nupcias, no teniendo el hombre esa condicionante; entre otros artículos con disposiciones subjetivas y discriminatorias.

Les articles attaqués se réfèrent à l’âge minimum pour se marier, à l’exercice de la tutelle légitime qui donne priorité au grand-père paternel et laisse au dernier rang les grand-mères maternelles, au droit de la femme qui n’est pas coupable (en cas de séparation ou de divorce) de percevoir une pension alimentaire à condition de faire preuve « d’une bonne conduite », au délai d’attente que la femme doit respecter avant de contracter un nouveau mariage alors que ce délai n’est pas applicable à l’homme; d’autres articles contiennent également des dispositions subjectives et discriminatoires.

Статьи, о которых идет речь, касаются минимального возраста вступления в брак; права законной опеки (в данном случае закон отдает предпочтение деду по отцовской линии и ставит бабку по материнской линии на последнее место); права женщины, если она не признана виновной стороной при разъезде супругов или расторжении брака, получать от мужа алименты, если она "ведет себя добропорядочно"; срока, на протяжении которого женщина не имеет права вступить в новый брак (в отношении мужчин подобной нормы не предусмотрено), а также ряда других статей, содержащих субъективные по характеру и дискриминационные положения.
