ويمكن لقاضي التحقيق في أيِّ مرحلة من الإجراءات أن يتخذ التدابير المتعلقة بالإفراج إلى حين المحاكمة إمَّا بناء على طلب المتهم أو محاميه، أو بناء على طلب المدعي العام، بحكم منصبه، (المواد 148-157 من قانون الإجراءات الجنائية).

Release pending trial is granted by the investigating judge either at the request of the accused or the accused’s counsel, or upon an application from the Public Prosecution Service, or proprio motu, at any stage of the proceedings (arts. 148 to 157 of the Code of Criminal Procedure).

El juez de instrucción toma las medidas necesarias para conceder la libertad provisional, bien a pedido del acusado o de su abogado, bien a instancias de la Fiscalía, o bien de oficio, en cualquier etapa del proceso (artículos 148 a 157 del Código de Procedimiento Penal).
