Inden for faellesskabsretten er der ved forordning (EOEF) nr. 1768/92 (29) blevet indfoert et supplerende beskyttelsescertifikat, som skal yde kompensation for den tid, der gaar, fra der indgives patentansoegning for et laegemiddel, til der udstedes markedsfoeringstilladelse for det (30).
