If a Contracting Party that has notified a requirement of unity of the design under Article 13(1) is designated under the 1999 Act and this requirement is not satisfied, the designs may nonetheless be filed in the same international application, but the Office concerned may refuse protection pending compliance through a procedure of division of the international registration before that Office (refer to "Procedure following notification of refusal")3. In particular, the Federal Service for Intellectual Property (ROSPATENT) and the United States Patent and Trademark Office (USPTO) are likely to refuse the effects of an international registration pending compliance with the requirement of unity of design under their respective laws.

Si una Parte Contratante que ha notificado un requisito de unidad del dibujo o modelo conforme al Artículo 13.1) es designada en virtud del Acta de 1999 y no se cumple dicho requisito, los dibujos o modelos podrán incluirse en la misma solicitud internacional, pero la Oficina en cuestión podrá denegar la protección hasta tanto se cumpla ese requisito Federal de Propiedad Intelectual (ROSPATENT) y la Oficina de Patentes y Marcas de los Estados Unidos (USPTO) denieguen los efectos de un registro internacional hasta que se dé cumplimiento al requisito de unidad del dibujo o modelo conforme a sus respectivas legislaciones.
