واستناداً إلى استنتاجات الفريق العامل، وتوخياً لكفالة الحماية من تكرار الحرمان من الحرية، يركز الفريق العامل على عدد من القضايا التي يود أن يوجه عناية الحكومة إليها، ومن بينها حماية الحق في الخضوع لإجراءات قضائية مراعية للأصول وفي محاكمة عادلة؛ واستقلال السلطة القضائية وبخاصة فيما يتصل بالمساواة في وسائل الدفاع وصلاحيات الادعاء؛ وتوقيع الأحكام المبالَغ في شدتها والقاسية؛ وعدم استخدام بدائل الحرمان من الحرية؛ ونظام التفاوض لتخفيف العقوبة؛ والاحتجاز الإداري؛ والاحتجاز في سياق المظاهرات السلمية؛ والقضايا المتصلة بملتمسي اللجوء والمهاجرين غير الشرعيين.

On the basis of its findings and to safeguard against occurrences of arbitrary deprivation of liberty, the Working Group focuses on a number of issues it wishes to draw to the Government’s attention, including, the protection of the right to due process and a fair trial; the independence of the judiciary particularly in relation to equality of arms and the powers of the prosecution; excessive and harsh sentencing; the lack of use of alternatives to deprivation of liberty; the plea bargaining system; administrative detention; detention in the context of peaceful demonstrations; and issues relating to asylum-seekers and irregular migrants.

El Grupo de Trabajo, basándose en sus conclusiones y con el fin de evitar la incidencia de la privación arbitraria de libertad, se centra en una serie de cuestiones que quiere señalar al Gobierno, en particular, la protección del derecho a las garantías procesales y a un juicio justo; la independencia de la judicatura, especialmente en lo relativo a la igualdad de armas; y las facultades de la fiscalía; la imposición de penas excesivas y severas; la falta de recurso a medidas alternativas a la privación de la libertad; el sistema de negociación de la pena; la detención administrativa; la detención en el contexto de manifestaciones pacíficas; y otras cuestiones relacionadas con los solicitantes de asilo y los migrantes irregulares.

Fort de ces conclusions et afin de prévenir le recours à la privation arbitraire de liberté, le Groupe de travail souhaite appeler l’attention du Gouvernement sur un certain nombre de questions, parmi lesquelles: la protection du droit à une procédure régulière et à un procès équitable; l’indépendance de la magistrature, s’agissant en particulier de l’égalité de moyens («égalité des armes») et des attributions de l’accusation; l’imposition de peines excessives et sévères; le recours insuffisant à des mesures de substitution à la privation de liberté; le plaider-coupable; la détention administrative; la détention à la suite de manifestations pacifiques et les questions relatives aux demandeurs d’asile et aux immigrés clandestins.

Исходя из таких выводов и ставя цель гарантировать недопущение произвольного лишения свободы, Рабочая группа заострила свое внимание на ряде вопросов, на которые она хотела бы обратить внимание правительства, включая защиту права на соблюдение процессуальных гарантий и справедливый суд, независимость судебной власти, прежде всего в отношении процессуального равенства участников процесса и правомочий обвинения, вынесение чрезмерных и суровых приговоров, отсутствие альтернатив лишению свободы, систему сделок с правосудием, административный арест, задержания, связанные с мирными демонстрациями, а также вопросы, касающиеся лиц, ищущих убежище, и незаконных мигрантов.
