وتشير إلى طعن الدولة الطرف في مقبولية طلب صاحبة البلاغ في إطار الفقرة 1 من المادة 4 من البروتوكول الاختياري إذ أن صاحبة البلاغ لم تستفد من إمكانية التماس إذن لطلب إجراء مراجعة قضائية من جانب المحكمة العليا لرفض منحها تصريحا استنسابيا للبقاء في البلد لأسباب إنسانية.

It notes the State party’s challenge to the admissibility of the author’s claim under article 4, paragraph 1, of the Optional Protocol because the author did not avail herself of the possibility of seeking permission to apply for a judicial review by the High Court of the refusal to grant her discretionary leave to remain in the country on humanitarian grounds.
