Discussion between the Commissioners of the two Offices was initiated in April 2002 and resolved around August 2002. The joint prior art search program will be conducted based on independent prior art searches of relevant technical fields and then shared by the two countries. This program was similarly instituted by the Japanese Patent Office (JPO), the United States Patent and Trademark Office (USPTO) and other patent offices of developed countries in Europe and has been ongoing since 1993.

이는 지난 2002년 4월에 개최된 한?중 특허청장 회담에서 논의된사항으로서 8월초 양청 실무자 회의에서 세부 추진방안을 합의하게 된 것이다. 금번 중국과의 공동선행기술조사 사업의 추진 단계는 우선 양국에 공통으로 출원된 특허출원 및 해당 기술분야를 선정하고, 선정된 출원에 대한 선행기술조사를 독자적으로 실시한 후, 그 결과를 상호 제공하여 비교?검토하는 단계로 이루어질 예정이다. 공동선행기술조사 사업은 이미 1993년부터 일본, 미국 및 유럽의 선진국 특허청간에 진행중이며 우리나라도 일본과 1999년부터 3차례에 걸쳐 시행한 바 있다.
