وبغية البتّ في صحة ادعاء مخالفة أمر الحماية الاحترازية المقضي به، ترى هذه الشعبة أن أنسب إجراء يحقق العدالة في حالة القرارات القضائية هو الإجراء المحدد لمنح الحماية الدستورية. وعليه، ووفقاً لأحكام المادة 26 من القانون الأساسي لحماية الحقوق والضمانات الدستورية، يُستدعى المواطن دانييل سيبايّوس، رئيس بلدية سان كريستوبَل بولاية تَتشِرا، لجلسة استماع علنية تُعقد في غضون الست والتسعين ساعةً المقبلة من أجل الإدلاء بدفاعه، ليَثبُت إشعاره بقرار.

This Chamber believes that, to determine the existence or otherwise of the alleged failure to comply with the precautionary protection order issued, the procedure most likely to ensure that justice is done is the procedure established for constitutional protection orders, and for this reason, in accordance with the provisions of article 26 of the Organic Act on the Protection of Constitutional Rights and Guarantees, hereby summons Daniel Ceballos, mayor of the municipality of San Cristóbal in Táchira State to a public hearing to be held within ninety-six (96) hours of official receipt of notification, in order to present any evidence that might serve in his defence.

Esta Sala, para determinar el presunto incumplimiento al mandamiento de amparo cautelar decretado, estima que el procedimiento que más se adecúa para la consecución de la justicia en el caso de autos es el estipulado para el amparo constitucional, por lo que, de conformidad con lo dispuesto en el artículo 26 de la Ley Orgánica de Amparo sobre Derechos y Garantías Constitucionales, se convoca al ciudadano Daniel Ceballos, alcalde del municipio San Cristóbal del estado Táchira; a una audiencia pública que se celebrará dentro de las noventa y seis (96) horas siguientes a que conste en autos su notificación, para que exponga los argumentos que a bien tuviere en su defensa.

La Chambre, considère que, pour établir la nonexécution présumée de la décision d’amparo préventif, la procédure la plus appropriée dans l’intérêt de la justice en l’espèce est l’amparo constitutionnel; en conséquence, la Chambre invite le citoyen Daniel Ceballos, maire de la municipalité de San Cristóbal, état Táchira, conformément aux dispositions de l’article 26 de la loi organique d’amparo sur les droits et garanties constitutionnels, à comparaître à une audience publique qui se tiendra dans les quatre-vingt-seize (96) heures suivant l’enregistrement de sa notification, pour qu’il présente les arguments pour sa défense.

В интересах установления факта предполагаемого неисполнения принятого постановления об обеспечительной мере Палата считает, что процедура, которая предназначена скорее для отправления правосудия в случае судебных решений, применима и к мере по защите конституционных прав, в связи с чем в соответствии с положениями статьи 26 Органического закона о защите конституционных прав и гарантий гражданин Даниэль Себальос, мэр муниципалитета Сан-Кристобаль штата Тачира вызывается на открытое слушание, которое будет проведено в течение девяноста шести (96) последующих часов, что будет отмечено в материалах дела, чтобы привести доводы в свою защиту.
