ولاحظت اللجنة أنه ما زال ينبغي للفريق العامل أن يُكمل عمله بشأن مشروع المادة 17 مكررا ثانيا التي تتناول التدابير المؤقتة الصادرة عن محاكم الدولة تأييدا للتحكيم وبشأن "شرط الكتابة" الوارد في المادة 7، الفقرة 2 من القانون النموذجي والمادة الثانية، الفقرة 2 من "اتفاقية نيويورك" لعام 1958 بشأن الاعتراف بقرارات التحكيم الأجنبية وإنفاذها.(

The Commission also noted that the Working Group had yet to complete its work in relation to draft article 17 ter dealing with interim measures issued by state courts in support of arbitration and in relation to the “writing requirement” contained in article 7, paragraph 2, of the Model Law and article II, paragraph 2, of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the “New York Convention”).

La Comisión tomó nota asimismo de que el Grupo de Trabajo aún no había concluido su labor sobre el proyecto de artículo 17 ter, relativo a las medidas cautelares dictadas por tribunales estatales en apoyo del arbitraje, ni sobre el requisito de que el acuerdo de arbitraje figure por escrito, enunciado en el párrafo 2 del artículo 7 de la Ley Modelo y en el párrafo 2 del artículo II de la Convención de 1958 sobre el Reconocimiento y Ejecución de las Sentencias Arbitrales Extranjeras (“La Convención de Nueva York”) .
