إن لجنة حقوق الإنسان، إذ تذكِّر بمقررها 2003/109 المؤرخ 24 نيسان/أبريل 2003 بشأن رد المساكن والممتلكات في سياق عودة اللاجئين والمشردين داخلياً، وإذ تذكِّر أيضاً بقرارها 2004/28 المؤرخ 16 نيسان/أبريل 2004 بشأن حظر الإخلاء القسري، وإذ تحيط علماً بقرار اللجنة الفرعية لتعزيز وحماية حقوق الإنسان 2005/21 المؤرخ 11 آب/أغسطس 2005، تؤيد طلب اللجنة الفرعية بأن يقوم باولو سيرجيو بنهيرو بتجميع واستيفاء الدراسة المتعلقة برد المساكن والممتلكات للاجئين والمشردين داخلياً، وأن يتم نشر الدراسة الكاملة بعنوان "الحق في رد المساكن والممتلكات للاجئين وغيرهم من المشردين" وذلك كجزء من سلسلة دراسات حقوق الإنسان وبجميع اللغات الرسمية للأمم المتحدة.

The Commission on Human Rights, recalling its decision 2003/109 of 24 April 2003 on housing and property restitution in the context of the return of refugees and internally displaced persons, recalling also its resolution 2004/28 of 16 April 2004 on prohibition of forced evictions, and taking note of resolution 2005/21 of 11 August 2005 of the Sub‐Commission on the Promotion and Protection of Human Rights, endorses the request by the Sub‐Commission that Paulo Sérgio Pinheiro compile and update the study on housing and property restitution for refugees and internally displaced persons, and that the full study, entitled “The right to housing and property restitution for refugees and other displaced persons”, be published as part of the Human Rights Study Series, in all the official languages of the United Nations.

La Comisión de Derechos Humanos, recordando su decisión 2003/109, de 24 de abril de 2003, relativa a la restitución de la vivienda y el patrimonio en el contexto del regreso de los refugiados y los desplazados internos, recordando asimismo su resolución 2004/28, de 16 de abril de 2004, sobre la prohibición de los desalojos forzosos, y tomando nota de la resolución 2005/21 de la Subcomisión de Promoción y Protección de los Derechos Humanos de 11 de agosto de 2005, apoya la petición de la Subcomisión de que el Sr. Paulo Sérgio Pinheiro compile y actualice el estudio sobre restitución de la vivienda y el patrimonio de los refugiados y desplazados internos, y que la versión integral de ese estudio, titulado "El derecho a la restitución de la vivienda y el patrimonio de los refugiados y otras personas desplazadas", se publique en la serie de estudios de derechos humanos en todos los idiomas oficiales de las Naciones Unidas.

Комиссия по правам человека, ссылаясь на свое решение 2003/109 от 24 апреля 2003 года о реституции жилья и имущества в контексте возвращения беженцев и внутренних перемещенных лиц и ссылаясь также на свою резолюцию 2004/28 от 16 апреля 2004 года о запрещении принудительных выселений и принимая к сведению резолюцию 2005/21 Подкомиссии по поощрению и защите прав человека от 11 августа 2005 года, одобряет просьбу Подкомиссии о том, чтобы Паулу Сержиу Пиньейру свел воедино и обновил исследование о реституции жилья и имущества беженцев и внутренних перемещенных лиц и чтобы полное исследование, озаглавленное "Право на реституцию жилья и имущества беженцев и других перемещенных лиц", было опубликовано в серии исследований по правам человека на всех официальных языках Организации Объединенных Наций.
