El accionante, ex combatiente en la Guerra de las Malvinas, reclamó que se le asegurase preferencia para ingresar a trabajar en la Administración de la Ciudad de Buenos Aires, según se había comprometido el Gobierno públicamente. El fallo hizo lugar a la demanda exponiendo que, de lo contrario, se incurriría “en una sutil conducta discriminatoria” al utilizar a una minoría determinada como la de ex combatiente para presentarla como beneficiaria de derechos cuyo ejercicio no se les permite realizar”
