وأُعرب عن تأييد قوي للاستعاضة عن مفهوم الاخفاق الوارد في التوصية بصيغة تشير إلى انتهاك مادي أو جوهري لشروط الخطة وتقصير مادي أو جوهري بمقتضى الخطة، والاستعاضة عن كلمة "ينبغي" بكلمة "يجوز" في الجملة الثانية.

Strong support was expressed for replacing the concept of failure in the recommendation with language indicating a material or substantial breach of the terms of the plan and a material or substantial default under the plan, and replacing “should” in the second sentence with “may”.
