In its initial reply, the State gave an overview of the history of Mr. Grijalva’s case before the Ecuadorian courts; it also stated that the appropriate and effective domestic remedies for resolving the petitioner’s legal situation had not yet been exhausted since there was still an outstanding criminal case against Mr. Grijalva for allegedly collecting illicit sums of money and granting fuel permits, initiated by the military criminal judge of the First Naval Zone, who commenced the trial proceedings on June 15, 1994.

En su respuesta inicial, el Estado reseñó la historia procesal del caso del señor Grijalva seguido ante las autoridades judiciales ecuatorianas, indicando que no se han agotado los recursos internos adecuados y eficientes para solucionar la situación jurídica del peticionario debido a que aún se encuentra pendiente un proceso penal en contra del señor Grijalva por presuntos cobros indebidos de dinero y otorgamiento de permisos de combustible, el cual inició el Juez Penal Militar de la Primera Zona Naval dictando auto cabeza de proceso el 15 de junio de 1994.
