In our opinion, the most that can be said of this excerpt is that it is based on evidence that was apparently different from that heard and accepted by the board of referees regarding the total number of employees: it certainly does not indicate that the board of referees committed an error of the type specified in s 95(c) of the Act 1 which could be a basis for intervention by an umpire.
