- As regards the right to be represented before a Court of Appeal, the Cour de cassation has given an important judgment (Cassation plenary, 2 March 2001, Vicenzo Dentico) in which it held that "the right to a fair trial and the right of every person accused to be represented by counsel are opposed to a court’s judging an accused who fails to be present without excuse, without giving a hearing to the accused person’s counsel, if present in the court".

- En ce qui concerne le droit d’être représenté par son avocat dans une procédure d’appel, la Cour de cassation a rendu un important arrêt (Cass. Plénière, 2 mars 2001, Vicenzo Dentico) dans lequel elle a dit que « le droit au procès équitable et le droit de tout accusé à l’assistance d’un défenseur s’opposent à ce que la juridiction juge un prévenu non comparant et non excusé sans entendre l’avocat présent à l’audience pour assurer sa défense ».
