فإذا اختارت العاملة عدم العودة إلى العمل، كان على رب العمل الإقرار بحقها في التعويض عن الفصل وكذلك، فيا يتعلق بالضرر والأذى، حقها في المبالغ المماثلة لاستحقاقات ما قبل الولادة وما بعدها، وفي الأجور التي كفت عن تقاضيها من لحظة فصلها حتى تمام الشهر الثامن من الحمل
