In accordance with article 88 of the Migration and Aliens Act, the Migration and Aliens Department shall deport foreigners in any of the following circumstances: (a) when they enter or reside in the country with forged documents without prejudice to any relevant criminal proceedings; (b) when they remain in the country although their residence permit has been annulled; (c) when they entered the country illegally or without complying with the rules laid down in this Act or its Regulations concerning the admission of foreigners; and (d) when they remain in the country beyond the authorized period of residence. In such cases, however, the Migration and Aliens Department may commute deportation to a pecuniary sanction without prejudice to the option to extend the residence permit for the additional period permissible under the Act or its Regulations.

De conformidad al artículo 88 de la Ley de migración y extranjería, la Dirección General de Migración y Extranjería procederá a deportar a todo extranjero que se encuentren en cualquiera de las circunstancias siguientes: a) cuando ingrese o permanezca en el país con documentos falsos sin perjuicio de la acción penal correspondiente; b) cuando después de habérsele cancelado la residencia permanece en el país; c) cuando haya ingresado al país clandestinamente o sin cumplir las normas de esta ley o su reglamento sobre admisión de extranjeros; y d) cuando se extralimitare en el tiempo de permanencia autorizado sin abandonar el país; sin embargo, en estos casos la Dirección General de Migración y Extranjería podrá conmutar la deportación por una sanción pecuniaria sin perjuicio de la facultad de prorrogar el permiso de permanencia por el tiempo adicional que establezca la ley o su reglamento.
