Article 347-1 of the Criminal Code establishes criminal responsibility for the deliberate infliction of physical or mental suffering by an investigator, the person conducting the initial inquiry or any other official in order to obtain from the person being tortured or a third party information or a confession, or to punish such person for an act that he or she committed or is suspected of having committed, and also to intimidate or coerce him or her or a third party, or for any reason based on discrimination of any kind (punishable by deprivation of liberty for up to five years).

El artículo 347-1 del Código Penal establece la responsabilidad criminal del agente de investigación, de la persona encargada de instruir el sumario o de cualquier otro agente que ocasione deliberadamente sufrimientos físicos o mentales a fin de obtener de la persona sometida a tortura o de un tercero información o una confesión, de castigar a esa persona por un acto que haya cometido, o se sospeche que ha cometido, de intimidar o coaccionar a esa persona o a un tercero, o por cualesquier motivo basado en cualquier tipo de discriminación (actos sancionables con privación de libertad de hasta cinco años).

L’article 347‐1 du Code pénal réprime (d’une peine de privation de liberté d’une durée de cinq ans au plus) le fait pour un agent d’instruction, un enquêteur ou tout autre fonctionnaire d’infliger délibérément des souffrances physiques ou mentales pour arracher à la personne torturée ou à une tierce partie des informations ou des aveux, ou pour punir cette personne d’un acte qu’elle a commis ou est soupçonnée avoir commis, de même que pour intimider ou contraindre cette personne ou une tierce partie, ou pour toute raison fondée sur quelque forme de discrimination que ce soit.

В Уголовном кодексе статьей 347-1 установлена уголовная ответственность за умышленное причинение физических и психических страданий, совершенное следователем, лицом, осуществляющим дознание, или иным должностным лицом с целью получить от пытаемого или третьего лица сведения или признания либо наказать его за действие, которое совершило оно или в совершении которого оно подозревается, а также запугать или принудить его или третье лицо, или по любой причине, основанной на дискриминации любого характера (в виде лишения свободы на срок до 5 лет).
