(50) يكتسي هذا الحكم أهمية كبرى لأنه يلفت الانتباه إلى انتهاكات الحقوق الأساسية التي تتواكب مع التشريد القسري، وإلى مسؤولية الدولة عن قصور آليات الحماية، وإلى النمط الواقعي للتشريد، وإلى افتراض النية السليمة لدى الدولة، وإلى ما ينجم عنه من تحويل عبء الإثبات إلى الطرف الآخر.
