La chambre de recours a par ailleurs relevé, au point 12 de la décision attaquée, que le fait d’utiliser le signe typographique « & », signifiant « et », ne changeait rien en ce qui concerne le caractère distinctif du signe, car l’emploi de ce signe typographique était banal dans la langue anglaise.
