وعبارة "النظام القانوني"، في سياق الإعلان العالمي، ينبغي فهمها على أنها إشارة إلى نظام قانوني دستوري تكون فيه صلاحيات السلطة الحكومية والقيود التي تحد منها، فضلاً عن حقوق المواطنين وحرياتهم، معترفاً بها ومرسخة في مجموعة من القوانين تكون لها الأسبقية على التشريعات الخاضعة لها، ويكون إقرارها أو تعديلها خاضعاً لإرادة الشعب السيادية وحدها.

The expression “rule of law”, in the context of the Universal Declaration, should be understood as a reference to a constitutional rule of law, whereby the powers and limits of governmental authority, as well as the rights and freedoms of citizens, are recognized and established in a legal corpus which takes precedence over subordinate legislation, and whose approval or modification is subject to the sovereign will of the people.

La expresión "régimen de derecho", en el contexto de la Declaración, debe entenderse como la referencia a un estado constitucional de derecho, en el que las potestades y límites del poder público, así como los derechos y las libertades de los gobernados, son reconocidos y establecidos en un cuerpo legal con supremacía sobre la ley secundaria, cuya aprobación y modificación sólo puedan ser ejercidas por la voluntad soberana del pueblo.
