38 Appellanten har gjort gaeldende, at selv om det endnu ikke udtrykkeligt fremgaar af en bestemmelse i vedtaegten, boer det anerkendes som et grundlaeggende princip inden for faellesskabsretten vedroerende ansaettelser, at ansaettelsesmyndighedens ret til at opsige en midlertidigt ansats kontrakt suspenderes under en invaliditetsprocedure.

38 Die Rechtsmittelführerin trägt vor, es müsse als tragender Grundsatz des Beamtenrechts der Gemeinschaften anerkannt werden, daß das Recht der Anstellungsbehörde, den Vertrag eines Bediensteten auf Zeit zu kündigen, während eines Invaliditätsverfahrens ausgesetzt sei, auch wenn dies bisher in keiner Bestimmung des Statuts ausdrücklich geregelt sei.
