تلاحظ الفقرة 3(ب) من قانون 2011، التي تعدّل أحكام المادة 34 (4) (ب) من قانون 1994، على نحو صريح أنه عندما يكون السعر هو المعيار الوحيد لإرساء العقد يكون العطاء الأدنى سعراً هو العطاء الفائز، وعندما تكون هناك معايير أخرى إلى جانب المعايير السعرية، يكون العطاء الفائز هو العطاء الأكثر مزايا الذي يُتيقَّن منه ليس فقط بالاستناد إلى المعايير (كما ورد في قانون 1994) بل أيضاً بالاستناد إلى تطبيق إجراءات تقييم العطاءات المحدَّدة في وثائق الالتماس.

Amending the provisions of 1994 article 34(4)(b), 2011 paragraph 3(b) expressly notes that, where price is the only award criterion, the lowest priced tender is the successful one, and where there are award criteria in addition to the price, the successful tender is the most advantageous tender ascertained not only on the basis of the criteria (as in the 1994 text) but also applying the procedures for evaluating tenders specified in the solicitation documents.

En el apartado b) del párrafo 3 del texto de 2011, que modifica las disposiciones del apartado b) del párrafo 4 del artículo 34 del texto de 1994, se señala expresamente que, cuando el precio sea el único criterio de adjudicación, la oferta ganadora será aquélla cuyo precio sea más bajo, y cuando existan otros criterios de adjudicación, además del precio, la oferta ganadora será aquella que sea calificada de más ventajosa no solo en función de los criterios (como en el texto de 1994) sino también de los procedimientos de evaluación de las ofertas enunciados en el pliego de condiciones.

L’article 43-3 b) du texte de 2011 modifie les dispositions de l’article 34-4 b du texte de 1994, en précisant que, lorsque le prix est le seul critère d’attribution, l’offre à retenir est celle au prix le plus bas, et lorsque l’attribution se fait en fonction du prix et d’autres critères, l’offre à retenir est l’offre jugée la plus avantageuse non seulement sur la base des critères (comme dans le texte de 1994) mais aussi en appliquant les procédures d’évaluation des offres spécifiées dans le dossier de sollicitation.

в пункте 3(b) статьи 43 закона 2011 года, заменившем пункт 4(b) статьи 34 закона 1994 года, уточняется, что, когда единственным критерием заключения договора является цена, выигравшей тендерной заявкой является тендерная заявка с самой низкой ценой, а когда наряду с ценой имеются другие критерии заключения договора, то выигравшей тендерной заявкой является наиболее выгодная тендерная заявка, которая определяется не только на основе критериев (как в законе 1994 года), но и с применением процедур оценки, указанных в тендерной документации.
