. ورأت المحكمة ، على وجه الخصوص ، أن البائع برهن عن الجهود المعقولة التي بذلها والمتمثلة في إعادة بيع البضائع ، عبر الاثبات بأنه بحث عن مشترين في كافة أنحاء العالم وقدم تفسيرا معقولا للسبب الذي حال دون أن يعود عليه بيع البضائع بثمن يوازي ذلك الوارد قي العقد الأصلي ؛ كما قدم البائع الأدلة التي تفيد بأنه كان قد بذل أقصى ما بوسعه لإعادة بيع البضائع ، عبر الإثبات بأن الجزء الذي قرر التخلص منه هو عبارة عن تجهيزات لا يمكن إعادة بيعها ؛ أما في ما يتعلق بالإشعار ، فكان البائع قد ابلغ المشتري بموجبه بالعزم على البيع ، وعلى الرغم من أنه لم يعلم المشتري بعزمه على التخلص من بعض التجهيزات التي لا فائدة منها ، الا أن الأخير لم يُجب على الاشعارات بالبيع ، وبدا من الواضح أنه غير مهتم فعلا باستلام البضائع وأنه لم يكن محط إجحاف .

Specifically, the tribunal found that the seller proved it had made reasonable efforts in reselling the goods by showing that it had sought buyers all over the world and by offering a reasonable explanation for why the goods did not fetch as much as the original contract price; the seller also demonstrated that it had used its best efforts to resell the goods by showing that the part of the equipment the seller decided to scrap could not be resold; with respect to notice, the seller had informed the buyer of its intention to resell, and although it had not notified the buyer of its intention to scrap some equipment, the buyer had never responded to the sales notices, and it was clear that the buyer was not genuinely interested in receiving delivery of the goods and had not been prejudiced.

Concretamente, el tribunal concluyó que el vendedor había demostrado haber realizado esfuerzos razonables para revender las mercaderías ya que había acreditado la búsqueda de compradores en todo el mundo y dado explicaciones convincentes sobre por qué las mercaderías no se habían vendido al precio inicialmente estipulado en el contrato; el vendedor había demostrado asimismo que se había esforzado al máximo en revender las mercaderías al probar que la parte del equipo que había decidido desechar no podía revenderse; en cuanto a la notificación, el vendedor había informado al comprador de su intención de vender, y aunque no le había comunicado su propósito de desechar parte del equipo, el comprador nunca había respondido a sus avisos de venta, y estaba claro que no estaba realmente interesado en la entrega de las mercaderías y que no había sufrido daños y perjuicios.
