Right to compensation in the event of unjustified conviction Article # of the Criminal Procedure Code stipulates that in the event of dismissing a criminal case because no criminal offence has been committed, the offence has no corpus delicti (constituent elements of a crime) or because the participation of the person in the commission of the criminal offence has not been proved, as well as in the event of passing a judgement of acquittal, the duty of investigating agencies, the Prosecutor's Office and court is to explain to the person the procedure under which the person can be restored to his rights and receive compensation for the incurred damage

El artículo # del Código de Procedimiento Penal dispone que si se desestima una causa penal por no existir delito, porque no se ha encontrado el corpus delicti (los elementos constitutivos del delito) o porque no se ha demostrado la participación del reo en su comisión, y también cuando se hubiese pronunciado una sentencia condenatoria, incumbe a los órganos encargados de la investigación, al ministerio público y al tribunal explicar al encausado el procedimiento para lograr el restablecimiento de sus derechos y percibir una indemnización por los daños sufridos
