وبينما ترى اللجنة، استناداً إلى الأدلة المعروضة عليها في هذه القضية، أنه ليس من الضروري تناول هذا الانتهاك المحتمل في إطار نظرها في الأسس الموضوعية، فإن إعلان مقبولية البلاغ يبين أن اللجنة مستعدة للنظر في هذه الحجج ويعكس النهج السائد في القانون الدولي لحقوق الإنسان المتمثل في الابتعاد عن التقسيم المفتعل والمصطنع للحقوق إلى "فئات" والاتجاه نحو النظر إلى جميع حقوق الإنسان بوصفها عالمية ومترابطة.

While in this case the Committee, on the basis of the evidence before it, did not find it necessary to address this possible violation in its consideration of the merits, the declaration of admissibility shows that the Committee is prepared to consider such arguments and reflects the trend in contemporary international human rights law away from the fictitious and artificial division of rights into “categories” and towards the view that all human rights are universal and interdependent.

Si bien el Comité, de acuerdo a las pruebas que obraban en su poder, en el caso no consideró necesario abordar esta posible violación en el fondo del asunto, la declaración de admisibilidad muestra la predisposición del Comité a atender posibles argumentaciones en dicha dirección, y comprueba que en el contemporáneo derecho internacional de los derechos humanos, se avanza hacia dejar atrás la ficticia y artificial división de derechos en "categorías", dando paso a la universalidad e interdependencia de todos los derechos humanos.

Bien que, au vu des éléments dont il disposait, le Comité n’ait pas jugé nécessaire d’examiner cette violation potentielle sur le fond, en déclarant la plainte recevable il a montré qu’il était disposé à étudier des argumentations dans ce sens et a signifié que dans le droit international des droits de l’homme contemporain la séparation fictive et artificielle des droits en «catégories» cède le pas à l’universalité et à l’interdépendance de tous les droits fondamentaux.

В данном случае на основе имеющихся у него данных Комитет не счел необходимым затрагивать это возможное нарушение при рассмотрении дела по существу, однако признание сообщения приемлемым свидетельствует о том, что Комитет готов учитывать такие доводы, что отражает наметившуюся в современном международном праве по правам человека тенденцию к переходу от неестественного и искусственного деления прав на "категории" к принципу универсальности и взаимозависимости всех прав человека.
