Den omstaendighed, at den paagaeldende artikel overlader det til medlemsstaterne, ikke til faellesskabsinstitutionerne, at virkeliggoere de i artiklen fastsatte maal, skyldes, at domsmyndigheden i borgerlige sager, herunder handelssager, under alle omstaendigheder forbliver hos medlemsstaterne; dette er dog ikke til hinder for at antage, at de bestemmelser, artikel 220 har for oeje, er omfattet af traktatens anvendelsesomraade, jf. artikel 2.

Der Umstand, daß in diesem Artikel den Mitgliedstaaten und nicht den Gemeinschaftsorganen die Aufgabe zugewiesen wird, die dort festgelegten Ziele zu verwirklichen, beruht darauf, daß die Gerichtsgewalt in Zivil- und Handelssachen weiterhin in die Hoheitsgewalt der Mitgliedstaaten fällt; dies steht allerdings nicht der Annahme entgegen, daß die mit diesem Artikel angestrebte Regelung in den Anwendungsbereich des EWG-Vertrags im Sinne von Artikel 2 fällt.

Το γεγονός ότι το άρθρο αυτό αναθέτει στα κράτη μέλη και όχι στα κοινοτικά όργανα την αποστολή της πραγματοποιήσεως των στόχων που θέτει οφείλεται στο ότι η δικαστική αρμοδιότητα σε αστικές και εμπορικές υποθέσεις εξακολουθεί εν πάση περιπτώσει να εμπίπτει στην κυριαρχία των κρατών. Πάντως, τούτο δεν απαγορεύει να θεωρηθεί ότι η συναφής ρύθμιση εμπίπτει στο πεδίο εφαρμογής της Συνθήκης κατά την έννοια του άρθρου 2.

The fact that that article entrusts to the Member States, and not to the Community institutions, the task of attaining the objectives which it sets is due to the fact that jurisdiction in civil and commercial matters remains, in any event, a matter within the sovereignty of the Member States; however, that does not preclude the conclusion that the rules with which it is concerned fall within the scope of application of the Treaty, for the purposes of Article 2.

La circunstancia de que el citado artículo atribuya a los Estados miembros y no a las Instituciones comunitarias la tarea de lograr los objetivos por él fijados, se debe al hecho de que la competencia judicial en materia civil y mercantil permanece, en cualquier caso, en el ámbito de la soberanía de los Estados; lo cual no es óbice, sin embargo, para considerar que la normativa a que se refiere está comprendida dentro del ámbito de aplicación de Tratado, a efectos del artículo 2.

Tal, contudo, não obsta à verificação de que a regulamentação que refere cai no campo de aplicação do Tratado, na acepção do artigo 2.
