وعند تقرير ما إذا كان ينبغي مقاضاة أحد الأفراد في المحكمة، يراعي المدعي العام في جملة أمور، المركز المزعوم للفرد المعني ومدى مشاركته المزعومة في الإبادة الجماعية، والصلة المزعومة التي قد تربط ذلك بقضايا أخرى، وضرورة تغطية المناطق الجغرافية الكبيرة في رواندا، ومدى توافر الأدلة فيما يتعلق بالفرد المعني وتوافر مواد التحقيق لإحالتها إلى دولة ما لغرض المحاكمة الوطنية

In determining whether an individual should be tried at the Tribunal, the Prosecutor considers, among other things, the alleged status and extent of the participation of the individual during the genocide, the alleged connection that the individual may have had with other cases, the need to cover the major geographical areas of Rwanda, the availability of evidence with regard to the individual concerned and the availability of investigative material for transmission to a State for national prosecution

Para determinar si una persona será enjuiciada ante el Tribunal, entre otras cosas la Fiscalía considera su presunta situación y la magnitud de la participación de esa persona durante el genocidio, la presunta relación que esa persona pueda tener con otras causas, la necesidad de abarcar las principales zonas geográficas de Rwanda, la disponibilidad de pruebas en relación con la persona del caso y la disponibilidad de material de investigación para su remisión a un Estado para que se proceda al enjuiciamiento en la jurisdicción nacional

Pour déterminer si un individu doit être jugé au Tribunal ou pas, le Procureur prend notamment en considération sa position présumée et son degré de participation au génocide, les liens qu'il est présumé avoir eus avec d'autres affaires, la nécessité de couvrir les principales zones géographiques du Rwanda, ainsi que la disponibilité d'éléments de preuve le concernant et d'éléments d'enquête à transmettre à l'État de renvoi aux fins de son jugement par la juridiction nationale

При определении того, следует ли то или иное лицо судить в Трибунале, Обвинитель учитывает, среди прочего, предполагаемый статус и масштабы участия данного лица во время геноцида, предполагаемую связь, которую данное лицо могло иметь с другими делами, необходимость охватить основные географические районы Руанды, наличие доказательств в отношении соответствующего лица и наличие следственных материалов для передачи какому-либо государству в целях судебного преследования на национальном уровне
