وكقاعدة عامة، تكون اتفاقات التسوية/التوفيق/الوساطة قابلة للتنفيذ على أساس مبدأَيْ الطوعية وحُسْن النيَّة لدى الأطراف (المادة 15 من قانون الوساطة، والمادتان 124 و157 من القانون الاقتصادي).
