وثمة استثناء يعطى أحيانا إذا كان المستأجر، وقت ابرامه عقد الايجار، على علم فعلي بأن الايجار ينتهك حقوق الدائن المضمون، كما هي الحال إذا كان المستأجر على علم بأن اتفاق الضمان الذي ينشئ ذلك الحق الضماني يحظر على المانح بالتحديد تأجير الممتلكات المعنية.

An exception is sometimes made if, at the time the lessee entered into the lease, the lessee has actual knowledge that the lease violates the rights of the secured creditor, as would be the case if the lessee knew that the security agreement creating such security right specifically prohibited the grantor from leasing the property.
