If the indication of the point of loading or discharge is not given in sufficient time before the place of loading or discharge is reached, or if the draught, the safety of the vessel or local regulations and installations do not permit the carrier to comply with the indications given, he may, in the absence of new guidelines and despite the request made to him in that regard, berth at any other suitable point of loading or discharge, taking the shipper’s or the consignee’s interests into consideration as far as possible.

Si l'indication du point de chargement ou de déchargement n'est pas donnée à temps avant l'arrivée au lieu de chargement ou de déchargement ou si le tirant d'eau, la sécurité du bateau ou les règlements et les aménagements locaux ne permettent pas de se conformer aux indications données, le transporteur peut, à défaut de nouvelles directives, malgré la demande qui lui en est faite, aborder à tout autre point de chargement ou de déchargement approprié, en tenant compte autant que possible de l'intérêt de l'expéditeur ou du destinataire.

Если пункт погрузки или выгрузки своевременно не указан до прибытия в место погрузки или выгрузки или если осадка, соображения безопасности судна или местные правила и оборудование не позволяют выполнить данные указания, то перевозчик может - если, несмотря на направленный им запрос, не поступило новых указаний - причалить к любому другому соответствующему пункту погрузки или выгрузки, учитывая в максимально возможной степени интересы грузоотправителя или грузополучателя.
